E Upon an offender's or delinquent child's personal appearance and completion of a verification form under division C of this section, a sheriff promptly shall forward a copy of the verification form to the bureau of criminal identification and investigation in accordance with the forwarding procedures adopted by the attorney general pursuant to section S "School" and "school premises" have the same meanings as in section After a delinquent child who has registered pursuant to division A 1 b of this section is released from the custody of the department of youth services or from a secure facility that is not operated by the department, the delinquent child shall register registerable sex offenses in ohio in Eydzhaks provided in division A 3 of this section.
If a juvenile court issues an order under division A 2 or 3 of section
The general assembly further declares that it is the policy of this state to require the exchange in accordance with this chapter of relevant information about sex offenders and child-victim offenders among public agencies and officials and to authorize the release in accordance with this chapter of necessary and relevant information about sex offenders and child-victim offenders to members of the general public as a means of assuring public protection and that the exchange or release of that information is not punitive.
H 1 Upon the motion of the offender or the prosecuting attorney of the county in which the offender was convicted of or pleaded guilty to the sexually oriented offense or child-victim oriented offense for which the offender is subject to community notification under this section, or upon the motion of the sentencing judge or that judge's successor in office, the judge may schedule a hearing to determine whether the interests of justice would be served by suspending the community notification requirement under this section in relation to the offender.
B The notice required under division A of this section shall include all of the following information regarding the subject offender or delinquent child: 1 The offender's or delinquent child's name. Individuals included within the registry are included solely by virtue of their conviction record and state law.
The sheriff shall not cause to registerable sex offenses in ohio in Eydzhaks publicly disseminated by means of the internet any of the information described in this registerable sex offenses in ohio in Eydzhaks that is provided by a delinquent child unless that child is in a category specified in division F 1 abor c of this section.
H An offender or public registry-qualified juvenile offender registrant who is required to verify the registerable sex offenses in ohio in Eydzhaks or public registry-qualified juvenile offender registrant's current residence, school, institution of higher education, or place of employment address pursuant to divisions A to C registerable sex offenses in ohio in Eydzhaks this section and a delinquent child who is not a public registry-qualified juvenile offender registrant who is required to verify the delinquent child's current residence address pursuant to those divisions shall do so for the period of time specified in section If a hearing is requested as described in this division, the offender or delinquent child shall appear at the hearing by video conferencing equipment if available and compatible, except that, upon the court's own motion or the motion of the offender or delinquent child or the prosecutor representing the interests of the state and a determination by the court that the interests of justice require that the offender or delinquent child be present, the court may permit the offender or delinquent child to be physically present at the hearing.
B In any case in which a motion requesting the issuance of a withholding order as described in division A of this section is filed, the offender may receive a hearing on the motion by delivering a written request for a hearing to the court prior to the expiration of thirty days registerable sex offenses in ohio in Eydzhaks the offender's receipt of the notice provided pursuant to division A of this section.
E No person registerable sex offenses in ohio in Eydzhaks is required to register pursuant to divisions A and B of this section, and no person who is required to send a notice of intent to reside pursuant to division G of this section, shall fail to register or send the notice as required in accordance with those divisions or that division.
E "Harmful to juveniles" means that quality of any material or performance describing or representing nudity, sexual conduct, sexual excitement, or sado-masochistic abuse in any form to which all of the following apply: 1 The material or performance, when considered as a whole, appeals to the prurient interest of juveniles in sex.
Registration period of tier I offender may be reduced to 10 years upon petition after 10 years. Thirds Column 3. At the hearing, the eligible offender has the burden of going forward with the evidence and the burden of proof by a preponderance of the evidence.
C Whoever violates this section is guilty of sexual imposition, a misdemeanor of the third degree. In any case in which a sentencing court orders restitution to the victim under section
A An offender or delinquent child who is required to register a residence address pursuant to division A 2 , 3 , or 4 of section The judge may dismiss the motion without a hearing but may not issue an order suspending the community notification requirement without a hearing.
A If an offender or delinquent child registers a residence address, provides notice of a change of any residence address, or verifies a current residence address pursuant to section The offender or delinquent child may contest the matters that are identified in division E of section As used in this division, "child day-care center," "type A family day-care home," and " type B family day-care home" have the same meanings as in section Arrow Left Arrow Right.
